Tide Offers General Terms and Conditions

Tide Platform Private Limited (“Tide”, “we”, “us” or “our”) gives you the chance to earn exciting rewards as part of its offers. 

Your participation in our offers is deemed to be your acceptance of these Tide Offers General Terms and Conditions (“Terms”). Please do not participate in our offers if you do not agree to these Terms. These Terms form a binding agreement between you and us. 

These Terms must be read in conjunction with the Offer Announcement (defined below). 

  1. These Terms 1.1 These Terms apply to all our offers. 1.2 Offers will be announced using push notifications, on call, email, SMS, WhatsApp, social media handles, the Tide app or a combination of these (the “Offer Announcement”). The Offer Announcement will set out: 1.2.1 The participation and eligibility criteria for the offer; 1.2.2 Rewards to be awarded to winners; 1.2.3 Where you can find these Terms; 1.2.4 The criteria which will be used to determine the winners; 1.2.5 The Opening Date and Closing Date (defined below), where applicable;  1.2.6 The Result Date (defined below), where applicable; and 1.2.7 Other applicable terms which will govern the offer.   1.3 The Offer Announcement may make a reference to further information being available on our website, social channels, or other forms of communication. Such further information will also form part of the Offer Announcement. 1.4 The Offer Announcement and these Terms will form the complete set of terms and conditions governing an offer. In case of conflict between the Offer Announcement and these Terms, the Offer Announcement will prevail.

  2. How To Enter 2.1 An offer will run from 00:01 on the opening date set out in the Offer Announcement (the “Opening Date”) to 23:59 on the closing date set out in the Offer Announcement (the “Closing Date”), both dates inclusive. 2.2 All entries for participation must be received by us by no later than 23:59 on the Closing Date. Entries received after the Closing Date will be automatically disqualified.

  3. Eligibility 3.1 Our offers are only open to residents of India aged 18 years or over. However, the following are not eligible to participate in offers: 3.1.1 Residents of the state of Tamil Nadu, where rewards are determined by lot, draw or any other mode of random selection. If you reside in Tamil Nadu, you must not participate in such offers; 3.1.2 Our and our affiliates’ employees; 3.1.3 employees of our agents or service providers who are professionally connected with the offers or its administration; and 3.1.4 immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren) of the persons mentioned in Clauses 3.1.2 and 3.1.3 (Eligibility). 3.2 By entering an offer, you confirm that you are eligible to do so and are eligible to claim the reward you may earn. We may require you to provide proof that you are eligible to enter the offer. 3.3 We reserve the right to disqualify any entries that are: 3.3.1 automatically generated by computer; 3.3.2 completed by third parties or in bulk; or 3.3.3 illegible, have been altered, reconstructed, forged or tampered with; or 3.3.4 found not to meet the offer requirements.   3.4 We will disqualify any person: (a) tampering with the entry process or the operation of an offer; (b) acting in violation of these Terms; (c) acting in a manner contrary to the spirit or intention of an offer; or (d) acting in an unsportsmanlike or disruptive manner or with intent to abuse, cause wrongful loss, defraud, threaten or harass any person. 3.5 Unless otherwise expressly provided, you cannot participate in an offer twice. Some offers may permit one entry for each day of the offer period.  3.6 Unless otherwise expressly provided, entries on behalf of another person will not be accepted and joint submissions are not allowed.

  4. The Rewards 4.1 The rewards will be set out in the Offer Announcement. 4.2 Rewards could be in any form, including goods, gift vouchers or direct cashback. The mode of reward will be specified in the Offer Announcement. Where a third party’s goods or services are offered as rewards, we are not responsible for their quality, utility, availability, limitations or performance. We give no warranty of any kind nor accept any liability in connection with such third-party goods or services distributed as rewards as part of an offer. 4.3 Where rewards are in the form of cashback, your rewards are contingent on you maintaining an active Tide Expense Card. If your Tide Expense Card is blocked, suspended, or closed, your outstanding rewards will be forfeited. 4.4 Graphics of the reward in any communication regarding an offer are for representation purposes only. The actual reward may differ in colour and appearance.  4.5 In circumstances beyond our control, we may substitute the reward with an alternative reward of equal value at our sole discretion.  4.6 If you earn a reward, you cannot transfer, assign, or redeem it for cash or other consideration.

  5. Winners Winners of an offer will be decided on the date (“Result Date”) specified in the Offer Announcement. If the Result Date is not stated in the Offer Announcement and in case of running offers, the Result Date will be at regular intervals during the offer period.

  6. Claiming The Reward 6.1 We will contact the winner personally as soon as practicable after the winners have been determined. You will not be able to amend any contact information once the offer entry is submitted. In case of an offer conducted via Instagram or Twitter, we will contact the winner through direct messages. To claim the reward, you must follow the instructions in our message and (a) provide any additional information required by us; and (b) pay us the applicable amount of tax to be deducted on the reward, in light of applicable provisions of the Income Tax Act, 1961. If you fail to claim the reward as per our message within 7 working days from the date of the message, you will be deemed to have forfeited your claim to the reward and we will dispose of the reward in our sole discretion. 6.2 In case where rewards are physical goods: Once you claim a reward (as per Clause 6.1 above), the reward will be delivered to your address registered with us, within 90 working days from the date on which you claim the reward. We want to ensure that all rewards are delivered to the right address. Thus, we may call you on your mobile number registered with us to verify your address before dispatching the reward. If you would like the reward to be delivered to an alternate address (i.e. an address not registered with us), we may conduct additional due diligence of the details submitted to our satisfaction. In such cases, the delivery of rewards may take longer than the aforesaid time period. We will not be able to deliver and will have to cancel the reward if our courier service does not deliver in your area of residence.  6.3 In case where rewards are in the form of cashback: Cashback will be credited in the prepaid payment instrument (PPI) associated with your Tide Expense Card. We will make the cashback payment within 60 days from the date you claim a reward (as per Clause 6.1 above) or within 60 days from the Result Date, whichever is later. 6.4 In case where rewards are in the form of Amazon gift cards: Gift cards will be sent to your email ID registered with us within 45 working days from the date you claim a reward (as per Clause 6.1 above) or within 45 working days from the Result Date, whichever is later. When you receive the reward in the form of an Amazon gift card, additional terms may apply to the redemption of the Amazon gift cards (including Amazon’s own terms). We advise you to review all information included with your Amazon gift card. If you avail of your Amazon gift card, Amazon will process your personal data (as a data fiduciary separate from us) in line with its privacy policy. You understand that we do not issue Amazon gift cards. Accordingly, we are not responsible for any issues relating to their use, redemption, limitations, or unavailability. We give no warranty of any kind nor accept any liability in connection with the Amazon gift cards distributed as part of our offers. 6.5 Rewards cannot be claimed by a third party on your behalf. We do not accept any responsibility if you are not able to claim the reward. 6.6 If we find that rewards have been delivered to you incorrectly, we reserve the right to cancel or set off such erroneously delivered rewards against any sums we owe you, subject to applicable law. We also reserve the right to withhold or forfeit any rewards we believe have been earned fraudulently. 6.7 You agree to not hold us, our directors, officers, employees, or service providers, responsible for any delays in delivery of rewards caused due to events beyond our reasonable control.

  7. Disclaimer And Limitation Of Liability 7.1 We are not responsible for: (a) any error in the operation of an offer, including for technical, network, telephone, computer, hardware or software malfunctions of any kind; (b) any inaccurate transmission of, or failure to receive any information on account of technical problems or traffic congestion on the Internet or at any website; (c) any lost, misdirected, late, incomplete, unintelligible or inaccurate participation information, whether caused by you or by any of the equipment or program associated with or utilized in an offer, or by any technical or human error while processing an offer; (d) any printing or typographical errors in any materials associated with an offer; or (e) injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with an offer. 7.2 All offers are being made on a “best effort” basis and participation in offers is voluntary. By participating in an offer, you agree to release from liability, and hold harmless us, and any of our affiliates, employees or agents representing or related to us and our services/products. This release is for all liability arising out of, or in connection with this offer, even if caused or contributed to by our negligence.

  8. Data Protection And Publicity 8.1 By participating in our offers, you give us and our affiliates permission to use your name, likeness, image, and appearance (collectively “Image”), as collected or received in relation to an offer, for our communications, promotions, events, or contests. You acknowledge that you will not receive any compensation for such use of your Image. You release us, our affiliates, and their agents and assigns from any claims arising out of or relating to such use of your Image. 8.2 Unless expressly provided otherwise, all personal data you submit in connection with an offer will be dealt with in accordance with our Privacy Policy

  9. General 9.1 Taxes: You (and NOT we) are responsible for all taxes, duties, levies or other statutory dues and charges payable in connection with any rewards you win under an offer. 9.2 Discretion: All offers are discretionary. To the extent permitted by applicable law, we reserve the right to modify, withdraw, or cancel an offer, amend the eligibility or disqualification criteria, change the rewards and amend these Terms in part or in full, at any time, in our sole discretion, with or without prior intimation. 9.3 Governing Law: Each offer and these Terms are governed by the laws of India. The courts at New Delhi will have the exclusive jurisdiction to adjudicate any dispute arising out of or relating to these Terms or any offer. 9.4 Waiver: Failure or delay by us to enforce these Terms will not be deemed to be a waiver of any Terms. 9.5 Force Majeure: Each offer is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, acts of God or any circumstance beyond our reasonable control (“Force Majeure Event”). We will be not liable for any delay or adverse effect caused to you because of a Force Majeure Event. 9.6 Operation: We do not conduct offers in association, sponsorship or partnership with other entities unless otherwise stated in the Offer Announcement.

  10. Grievances

Our decision as to the rewards and any associated computation will be final and binding. For any disputes or grievances about an offer or its rewards, you can reach out to us at indiasupport@tide.co within 30 days from the Result Date.
